Shopian, Aug 28 (NVI): Nomination papers for the forthcoming election in the 36 Zainapora constituency of Sarjan Ahmad Wagay Aka Sarjan Barakati have been rejected by the Returning Officer owing to incomplete documentation.
“The nomination on behalf of Wagay was submitted by his duly authorized representative before the last date of filing nominations at 2.55 P.M. on 27th August 2024,” reports available the News Vibes of India—(NVI) said.
It further reads, while scrutinizing the nomination papers, it came to the fore that the requisition lacked an oath certificate, which is a must according to Section 16 of the J&K Reorganization Act 2019. Since Wagay is presently detained at Central Jail Srinagar, the oath certificate was to be signed by Superintendent of Central Jail Srinagar and furnished prior to the deadline for scrutiny.
Also, the Returning Officer then provided the checklist and acknowledgment form to the authorized agent, indicating the nature of pertain where documents were missing, and the final cutoff remained August 28, 2024, at 11:00 am. The candidate’s representative did not furnish the full and valid documents by the stipulated time.
“On August 28, 2024, at 1:48 PM, WhatsApp filed an incomplete certificate for the oath, which is certainly not the proper means of filing. The certificate was also not endorsed by the Superintendent of Central Jail; thus, it was not established that the oath was made and subscribed at a time within the period of law,” the reports said.
With all these loopholes, the Returning Officer could not help but reject the nomination papers of Sarjan Ahmad Wagay during the scrutiny process.
This could change the electoral prospect of the 36 Zainapora constituency with the day for the elections approaching.(News Vibes of India)
