Srinagar, Mar 14 (NVI): A court in Srinagar has sentenced a man to one year of simple imprisonment in a cheque dishonour case under the Negotiable Instruments Act, officials said.
The judgment was delivered by the Special Mobile Magistrate (Passenger Tax and Electricity), Srinagar, in a case titled Mohammad Ashraf Wani vs Mushtaq Ahmad Kak.
The court convicted Mushtaq Ahmad Kak, son of Ghulam Mohammad Kak, a resident of Kantparistan Safa Kadal, Srinagar.
According to the case details, the complainant Mohammad Ashraf Wani, son of Habibullah Wani, a resident of Parraypora Majid Bagh, Srinagar, had paid ₹9 lakh to the accused in connection with the purchase of a property at Sariabala near the Municipal Complex in Srinagar.
However, the accused allegedly failed to hand over possession of the property or return the amount. Following repeated demands for repayment, the accused issued multiple cheques amounting to ₹9 lakh drawn on J&K Bank’s Safa Kadal branch.
When the cheques were presented for encashment, they were dishonoured, prompting the complainant to file a case under Section 138 read with Section 142 of the Negotiable Instruments Act, 1881.
After hearing the arguments and examining the evidence, the court found the accused guilty and sentenced him to one year of simple imprisonment at Central Jail Srinagar.
The court also imposed a fine of ₹18 lakh and directed that the amount be paid to the complainant as compensation.
It further ordered that in case the accused fails to pay the fine, the District Magistrate Srinagar shall identify and attach the movable or immovable properties of the accused and auction them in accordance with law to recover the compensation amount.
